PLEASE READ THESE TERMS AND CONDITIONS CLOSELY BEFORE ESTABLISHING SERVICE AND ACCESSING YOUR LOAN ACCOUNT. IF YOU DO NOT AGREE WITH THE TERMS AND CONDITIONS OF SERVICE, YOU MAY NOT ACCESS YOUR LOAN ACCOUNT OR OTHERWISE UTILIZE THE SERVICE.

This Loan Account Access Agreement (the "Agreement") establishes the terms and conditions that govern your use of the Loan Account Access Service (the "Service"). If you use the Service, you thereby indicate your consent to these terms and conditions. You may print a copy of this Agreement for your records now, or you may refer to this document later at your convenience.

(the "Association") is strongly committed to protecting the security and confidentiality of our customer information. The Association uses state-of-the-art technology in the ongoing development of its Service to ensure this security. We use several different methods to protect the Customer's account information:

• Customers can only access the Service with certain browsers that have a high security standard.
  
• Customers must have a valid access ID and Password to sign in.
  
• If no action is taken for 15 minutes, Customers will be automatically logged off the Service.

The Association hereby grants the Customer a non-exclusive, non-transferable, limited right to access, use and display the Customer’s Loan Account Information, on any machine(s) of which the Customer is the primary user. The right to access your loan information may not be transferred to another party or entity without the prior written consent and approval of, and any such transfer of this right may be subject to any limitations established by the Association.

The Customer ("you," "your," "yourself") agrees, acknowledges and understands:

• You shall provide the Association with information to enable the Association to identify yourself when you desire to access your Loan Account information. This may include, but not be limited to name, address, telephone numbers, e-mail addresses, code words and personal identification numbers. The Association agrees to hold this information in confidence and will not release this information unless otherwise allowed under Farm Credit Administration regulations, or as otherwise required by a court order or subpoena.
• The Loan Account information to be accessed under the terms of this Agreement is of a confidential nature. The Association shall take commercially reasonable and appropriate measures to maintain the confidentiality of the information provided and to prevent access by any other party.
• You expressly agree not to use this access in a manner that is prohibited by law or regulation or to facilitate the violation of any law or regulation. You shall hold the Association harmless for any illegal access.
• You shall be solely responsible for all charges associated with connecting to this access, including, without limitation, all telephone access charges, lines and the physical equipment required for access.
• You shall not give out any identifying information such as your PC Password to any other person. The Association may rely on your access ID and password to identify you when providing access to your Loan Account information.
  
• You shall never leave your Loan Account information displayed in an area accessible by others.
  
• You shall never leave your PC unattended while using the Service.
  
• You shall always exit the system by clicking on "Logout" at the top of the screen after using the Service.
• You shall notify at immediately if you suspect that your access ID and password have become known to any unauthorized person. Password resets obtained over the telephone are "temporary," and will expire 30 days after issuance, and require an online reset at first use.
• You have the affirmative duty under the terms of this agreement to immediately notify if you believe your Loan Account information to be inaccurate. The Association shall use its best faith efforts to ensure that your Loan Account information is accurate.
  
• You shall not rely upon any of your Loan Account information accessed under this Agreement for the purposes of pay-off information, tax reporting or like purposes. The material provided in your Loan Account information is solely for informational purposes and as an accommodation and convenience to you. The Association is not liable for any deficiencies in the accuracy, completeness, availability or timeliness of such information or for any financial or other decision made using this information.
  

The Service provided by the Association is generally available 365 days a year. However, it is necessary to interrupt the Service periodically to perform system maintenance and to update information. The maintenance and update periods may vary somewhat by geographic region due to different time zones. The Association may, at its discretion, extend the maintenance and update periods as needed to complete more extensive maintenance, system upgrades or to resolve Service problems.

The Association shall determine in its sole discretion what information will be made available to Customer electronically under this Agreement. The Association shall have the right to modify this service and/or this Agreement at any time and both shall be subject to modification without notice. A notice of any modification shall be published on the Association's home page at . The Customer’s continued use of the Service after such publishing shall be conclusive acceptance of such modifications.

The Association is not responsible for any computer virus or related problems, which may be attributable to services provided by any Access Service Provider. Neither the Association nor any other software supplier is responsible for any direct, indirect, special, incidental or consequential damages arising in any way out of the use of the Service. The entire liability of the Association and Other Software Suppliers and your exclusive remedy with respect to the use of the Service shall be the replacement of any browser or other software provided by the Association to use with the Service found to be defective.

LOAN ACCOUNT INFORMATION PROVIDED HEREUNDER IS PROVIDED AS IS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED. TO THE FULLEST EXTENT PERMISSABLE BY LAW, THE ASSOCIATION MAKES NO WARRANTIES AND SHALL NOT BE LIABLE FOR THE USE OF THIS SERVICE, INCLUDING, WITHOUT LIMITATION, ANY INTERRUPTION OF OR ERROR IN THE SERVICE UNDER ANY CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO THE NEGLIGENCE OF THE ASSOCIATION. UNDER NO CIRCUMSTANCES SHALL THE ASSOCIATION BE LIABLE FOR ANY SPECIAL OR CONSEQUENTIAL DAMAGES THAT ARE DIRECTLY OR INDIRECTLY RELATED TO THE USE OF, OR THE INABILITY TO USE, THIS SERVICE, EVEN IF THE ASSOCIATION HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO THE CUSTOMER RESIDING IN THOSE STATES. IF CUSTOMER IS A RESIDENT OF SUCH STATE, IN NO EVENT SHALL THE ASSOCIATION’S TOTAL LIABILITY TO SUCH CUSTOMER FOR ALL DAMAGES, LOSSES OR CAUSES OF ACTION EXCEED $1,000.00.

This Agreement constitutes the entire agreement concerning the use of this Service to access your Loan Account information and supersedes all prior agreements concerning this subject matter, either written or oral.

In the event any part or portion of this Agreement is deemed illegal or unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties and the remainder of the provisions shall remain in full force and effect.

In addition to any other rights of the parties to this Agreement, either party may terminate this Agreement at any time upon notice to the other party. The Association reserves the right to restrict, suspend or terminate the Service or access to the Loan Account information at any time, in whole or in part, without notice, upon the breach of any part of this Agreement.
